Terms of Service

These Terms of Service ("Terms") are an agreement between you and Anikwe Duru ("Wake," "we," "us") governing your use of the Wake mobile app and related services (the "App"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use Wake. By using the App you confirm you meet this requirement and can form a binding contract.

2. The service

Wake helps you build and follow a personalized morning routine and reflect on your days. Routines and insights are generated from the information you provide and are offered for general wellbeing and self-improvement purposes.

3. Not medical or health advice

Wake is not a medical device and does not provide medical, psychological, or professional health advice. Its content, routines, and insights are for general informational and wellness purposes only and are not a substitute for advice from a qualified professional. Do not rely on the App to diagnose, treat, or manage any health condition. If you have concerns about your health, consult a qualified professional. Use of the App is at your own discretion and risk.

4. Your account

You are responsible for keeping your login credentials secure and for activity under your account. Provide accurate information and keep it current. Notify us at support@trywake.org if you suspect unauthorized use. You may delete your account at any time from within the App.

5. Subscriptions, trials, and billing

Wake offers auto-renewing subscriptions purchased through the Apple App Store:

• Annual plan: a 7-day free trial, then $59.99 per year.
• Monthly plan: $9.99 per month, with no free trial.

Key terms (these match the App's purchase screen and Apple's rules):

• Payment is charged to your Apple ID at confirmation of purchase.
• If your plan includes a free trial, you will not be charged until the trial ends. Any unused portion of a free trial is forfeited if you purchase a subscription during the trial.
• Subscriptions auto-renew at the then-current price unless canceled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription anytime in your Apple ID account settings.
• Prices may change; we will give notice as required, and changes apply to future renewals.
• Except where required by law, payments are non-refundable; refunds, if any, are handled by Apple under its policies.

6. Your content

You retain ownership of the content you create in the App (such as your reflections and notes). You grant us a limited license to store, process, and display that content to operate and personalize the App for you. You are responsible for the content you submit and confirm you have the right to submit it.

7. Acceptable use

You agree not to: misuse or interfere with the App or its security; access it through unauthorized means; reverse engineer or copy it except as permitted by law; or use it to violate any law or the rights of others.

8. Third-party services

The App relies on third-party services (including Apple, our hosting and AI providers, and a weather service). Your use of those services may be subject to their own terms. We are not responsible for third-party services.

9. Intellectual property

The App, its content (excluding your own content), design, and trademarks are owned by Anikwe Duru or its licensors and are protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes under these Terms.

10. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that insights will be accurate.

11. Limitation of liability

To the maximum extent permitted by law, Anikwe Duru will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50.

12. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the App or other users. Provisions that by their nature should survive termination (such as Sections 6, 9, 10, 11, and 14) will survive.

13. Apple App Store terms

This section applies because you obtained the App through the Apple App Store:

• These Terms are between you and Anikwe Duru only, not with Apple. Apple is not responsible for the App or its content.
• Your license to use the App is limited to use on Apple-branded devices you own or control, per Apple's Usage Rules in the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the App. Any product warranty is our responsibility, not Apple's; to the extent any warranty is not effectively disclaimed, Apple may refund the purchase price (if any), and beyond that Apple has no warranty obligation.
• Apple is not responsible for addressing any claims relating to the App, including product-liability, legal/regulatory, or consumer-protection claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You represent that you are not located in a country subject to a U.S. Government embargo or on a U.S. prohibited-party list, and you will comply with applicable export laws.

14. Governing law and changes

These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-laws rules. We may update these Terms from time to time; we will post the updated version with a new "Last updated" date and, for material changes, provide notice in the App. Continued use after changes means you accept them.
